Separation Of Powers

The separation of powers is the dividing between governmental power. The separation of powers is designed to prevent the abuse of power from any of the branches of government. The separation of powers was started when the French philosopher Montesquieu saw flaws in the greek government. This is a very important part of today’s government and still serves the same purpose as it did back in Ancient Greece in which it started. When the Separation of Powers started in Ancient Greece, It created a more peaceful place for politics. If there wasn’t a separation of powers, there would be a nationwide Dictator rather than a President. Congress has become increasingly energetic and administrative, the judiciary willful and legislative, and the executive (in its institutional, not electoral, connection) tentative and judicial. Under these conditions, it is the Congress's and the Supreme Court's power that have grown at the net expense of the President's. (Charles Kesler) When the separation of powers first started, it had two branches, the executive and congress. After so many years in Greece, John locke, another philosopher added another branch. The Federal. 'tis necessary there should be a Power always in being, which should see to the Execution of the Laws that are made, and remain in force. And thus the Legislative and Executive Power come often to be separated. (John Locke) This quote from the famous philosopher John Locke says that power is always in motion and that the legislative and executive branches seem to have more power than the judicial. The branches of government have this limitation for a reason and are just as important today, as they were in Greece.

After the civil war, the court entered into a judicial and conservative outlook and that enhanced its own powers. After accepting the view of the 14 amendment, it was interpreted as to protect corporations and to get rid of laws that protected workers and abolished laws such as the ones that protected child labor and minimum wage. After the great depression, the FDR abolishid several newdeal programs. This upsetted many people and government officials. As a reaction to this act, several more amendments were introduced into congress one year after the great depression. One of these amendments included a law that required two thirds of a court to declare whether an act of congress was unsonstitutional and another law that would grant Congress the power to revalidate a federal law. After this, the FDR stayed quiet and out of the way while hoping for the antijudiacial republic would grow without the FDR having to join in the growth. The separation of powers is not only important, but it has a history of its use, and how it began.
